6.Returns Policy.

a) As a customer in good standing, and unless otherwise stated, you have 30 days to return any purchase, from the date of purchase, to claim a 'no questions asked' refund.

b) Your refund will always and without exception, exclude transaction charges, and postage and handling fees where applicable.

c) Merlin's Emporium has the right at any time and without notification, to re-classify you as a customer out of good standing.

d) Merlin's Emporium has the right at any time and without notification, to terminate your membership and ban your particulars including your IP/MAC address from further site membership.

7. Merlin's Emporium Member Agreement.

Ignorance will not be accepted as an excuse. The Member is responsible for abiding by the policies of each venue in regard to advertising.

10.Miscellaneous.

a. This Agreement shall all be governed and construed in accordance with the laws of Australia applicable to agreements made and to be performed in Australia. You agree that any legal action or proceeding between Merlin's Emporium and you for any purpose concerning this Agreement or the parties' obligations hereunder shall be brought exclusively in a federal or state court of competent jurisdiction sitting in Australia . Any cause of action or claim you may have with respect to the Service must be commenced within one (1) year after the claim or cause of action arises or such claim or cause of action is barred. Merlin's Emporium's failure to insist upon or enforce strict performance of any provision of this Agreement shall not be construed as a waiver of any provision or right. Neither the course of conduct between the parties nor trade practice shall act to modify any provision of this Agreement. Merlin's Emporium may assign its rights and duties under this Agreement to any party at any time without notice to you.
